In no event shall the aggregate liability of COWCORNER RECREATIONS PRIVATE LIMITED exceed the total amount that such User has paid to COWCORNER RECREATIONS PRIVATE LIMITED in the six-month period ending on the date of the claim, to a maximum of One Thousand Indian Rupees (INR 1000). The limitations shall apply to any theory of liability whether based on warranty, contract, statute, tort (including negligence), or otherwise, and whether or not COWCORNER RECREATIONS PRIVATE LIMITED has been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed its essential purpose.
9.9. The failure of COWCORNER RECREATIONS PRIVATE LIMITED to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
9.10. These terms shall be governed by and construed in accordance with the laws of Nagaland Government as well as the Republic of India. All claims, legal proceedings or litigation arising in connection with the Services will be brought solely in the relevant courts located in the city of Delhi/New Delhi – INDIA. Users consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum.
9.11. COWCORNER RECREATIONS PRIVATE LIMITED is a skill-based online poker game as per the Nagaland Prohibition of Gambling and Promotion and Regulation of Online Games of Skill Act, 2015.
9.12. COWCORNER RECREATIONS PRIVATE LIMITED game runs in India except for the states where it is banned or prohibited.

9.14. These Terms, including the Privacy Policy, are the entire agreement between COWCORNER RECREATIONS PRIVATE LIMITED and Users regarding the Services, superseding prior agreements.
9.15. COWCORNER RECREATIONS PRIVATE LIMITED may revise these Terms from time to time, with updates available on the mobile application. Users agree to be bound by the revised Terms by continuing to use the Services after the revisions become effective.
10.1. Any tax, levies, duties, or other applicable charges shall be paid by the user of the COWCORNER RECREATIONS PRIVATE LIMITED game.
10.2. TDS (Tax Deducted at Source) will be deducted on the net winning amount on COWCORNER RECREATIONS PRIVATE LIMITED before releasing the winnings, prize, product, or amount, regardless of what it is called.
10.3. In accordance with the TDS (Tax Deducted at Source) rules for game winnings in India, a 30% TDS will be deducted on any net winnings.
10.4. The person responsible for paying the prize shall collect the TDS amount from the winner before releasing the winnings.
10.5. Your prize is redeemable only after TDS deduction. The TDS amount will be paid to COWCORNER RECREATIONS PRIVATE LIMITED as per Section 194B, read with Section 115BB of the Income Tax Act, 1961.
10.6. Users must provide a valid PAN card copy to COWCORNER RECREATIONS PRIVATE LIMITED so that the appropriate TDS can be filed and deducted in accordance with tax regulations.
10.7. TDS must be paid within 24 hours of the winning. Please allow a period of 15 working days for the delivery of your prize after the TDS payment.
10.8. To claim your winning product, if TDS is applicable on your winnings (as per Section 194B, read with Section 115BB of the Income Tax Act, 1961), the winner has 24 hours from the time of winning to pay the TDS in order to claim their prize. If the user fails to pay the TDS within 24 hours, the winning will be considered expired.
11.1. COWCORNER RECREATIONS PRIVATE LIMITED provides the Services on an "as is" and "as available" basis without warranties of any kind, whether express or implied. COWCORNER RECREATIONS PRIVATE LIMITED does not guarantee the accuracy, reliability, or availability of the Services.
11.2. To the fullest extent permitted by law, COWCORNER RECREATIONS PRIVATE LIMITED shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Services.
11.3. COWCORNER RECREATIONS PRIVATE LIMITED total liability to any User for all claims shall not exceed the amount paid by the User to COWCORNER RECREATIONS PRIVATE LIMITED in the six months preceding the claim.
12.1. All deposits and purchases made and fees paid on COWCORNER RECREATIONS PRIVATE LIMITED to play or in connection with Real Money Games within the platform are final. All transactions are final. We recognize that customer satisfaction is extremely important to us, so only error-oriented transaction cases shall be reviewed.
12.2. You acknowledge that you will not be entitled to any refund due to the cancellation of games caused by factors that are beyond the reasonable control of COWCORNER RECREATIONS PRIVATE LIMITED.
13.2. It is possible that you sometimes face disruptions including, but not limited to, errors, disconnection or interruptions in communication because of issues in the Internet services, software, or hardware that you are using to avail of our Services.
13.3. COWCORNER RECREATIONS PRIVATE LIMITED shall not in any way be liable for any network disconnection on your computer, mobile, or device caused by any fault or error at your end and shall not compensate you for any losses arising from such disconnection. In case of any disruption of service at our end while a game is in progress, as determined by and solely at the discretion of COWCORNER RECREATIONS PRIVATE LIMITED, COWCORNER RECREATIONS PRIVATE LIMITED shall cancel the game and refund your points/cash regardless of the status of the game. While playing a cash game, you take full responsibility for the risk of internet disconnection or interruption of communication between your computer/mobile/device and the COWCORNER RECREATIONS PRIVATE LIMITED servers, any lag in or freezing of the game or software, or any other problems attributable to your computer/mobile/device or network. COWCORNER RECREATIONS PRIVATE LIMITED shall not be responsible for any disconnection of your computer, mobile, or device from the COWCORNER RECREATIONS PRIVATE LIMITED server, except in the case of a crash of the COWCORNER RECREATIONS PRIVATE LIMITED server. If there is a disconnection or disruption for a short time in the middle of a game, you shall remain seated at the table and can resume playing once the connection is restored unless you have been eliminated.

If you are not fully satisfied with any deposit/purchase made or fee paid on COWCORNER RECREATIONS PRIVATE LIMITED and feel there is an "Error" in the transaction, please let us know about that within 3 days from the transaction date, and we shall certainly review the transaction and determine the resolution at our own discretion.
13.5. If the claim is accepted, the refund will be processed and credited back to the source account within 7-8 business days.
14.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of India. All disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Haryana, India.
